San Diego prosecutors have announced that Buffalo Bills punter Matt Araiza would not face charges following gang rape allegations.

The allegations arose after a 17-year-old girl accused the then-college football player and two of his teammates of gang rape. Matt Araiza retained San Diego criminal defense attorney Kerry L. Armstrong to defend against these charges. 

Attorney Armstrong aggressively defended against these allegations, asserting that Araiza did not force the girl to have sex, nor did he have any sexual relations with her while she was intoxicated.

In a Matt Araiza update, Attorney Armstrong stated that most of the accuser’s story did not comport with the evidence. The San Diego deputy district attorney explained that she could not prove that Araiza was at the party when the alleged gang rape occurred.

Additionally, the deputy district attorney noted that she could not prove that the alleged perpetrators knew that the accuser was a minor or that she was too intoxicated to consent. 

California law imposes significant punishments for those convicted of rape. Rape is a felony offense in California, and those convicted can face up to eight years in prison, with additional time if the victim experienced great bodily injury.

While accusers can present various types of evidence to substantiate their claims, prosecutors look for evidence of violence, coercion, or fraud. If prosecutors fail to find evidence of force, threats, or coercion, they may also prove their case by showing that the accuser did not consent or was intoxicated. 

Attorney Armstrong notes that this Matt Araiza news story is a prime example of how false and unprovable accusations can have a devastating ripple effect on every aspect of an accused person’s life.
